In an article in the Wall Street Journal, Professor James Fanto commented on a recent unsuccessful class-action suit related to leveraged exchange-traded funds (ETF). Although the Securities and Exchange Commission has said leveraged ETFs are confusing to investors, federal courts have generally sided with investment companies. “Judges are reluctant to punish companies just because investors are disappointed in returns,” Professor Fanto explained. "The bar is high in such cases.”
