Evidence Workshop: the Law of Privilege
In this course, we will examine various privileges in depth. Our primary focus will be on the attorney-client privilege, and will include particular attention to its application when a legal entitiy, such as a corporation, is the client, and to waivers of the privilege, for example through selective or inadvertent disclosure of confidential communications. We will aslo consider the marital, journalist, deliberative process and executive privileges. The course will be a "workshop" in that we will combine reading and discussion of leading cases with practical exercises, such as arguing motions to compel and counseling clients.Grading and Method of Evaluation
Letter grade with pass/fail option. Students are graded on in-class exercises, class participation and a short paper based upon the readings assigned and discussed during the semester.
