The #MeToo movement exposed not just the pervasiveness of sexual assault, but also the role of nondisclosure agreements (NDAs) covering settlements of sexual misconduct claims. Critics of NDAs contend that they are used to silence the victims of sexual assault, thereby shielding misconduct. Scrutiny is now falling on the NDAs themselves, with state reforms limiting their uses in sexual harassment cases and renewed questions about their private value and public harms.

Against this background, Brooklyn Law School’s annual Trade Secrets Institute Symposium will bring together expert practitioners and scholars for a balanced discussion of the uses and misuses of NDAs, the changing role of confidentiality, and the shape of future reform.
