Law & Technology
Law, technology, and the intersections between them shape the world we live in. In this course we'll explore and critically analyze the role that law plays in regulating the creation, use, and effects of emerging technologies. We will discuss the challenges that lawyers and judges face when applying existing legal frameworks to novel technologies. And we'll explore the considerations and constraints that lawmakers encounter when deciding whether, when, and how to regulate novel technologies. The course will have three main parts. We'll first set foundations by introducing "law and technology" as a field, exploring how law affects technology and vice versa. Then, we'll examine some of the major controversies in the field, discussing topics such as online speech, privacy, health technologies, cryptocurrencies, and artificial intelligence. Finally, we'll ask how (or whether) novel technologies challenge core doctrines and theoretical foundations in major legal domains, including contracts, torts, evidence, and criminal law. Throughout the course, students will develop the analytical tools needed to identify, evaluate, and address the legal and social challenges posed by technological change. Grading and Method of Evaluation: Letter grade with pass/fail option, based on final exam and class participation.
