Electronic Discovery Law and Process Workshop
This course will introduce students to the substantive and procedural issues surrounding electronic discovery in civil and criminal cases. Students will learn about (1) the basics of information technology and the electronic storage of information ("ESI"), (2) legal issues surrounding preservation, production, privilege and allocation of costs regarding ESI, (3) ethical aspects associated with ESI, and (4) motion practice regarding ESI. The course will emphasize the Federal Rules of Civil Procedure and accompanying caselaw, and will also cover related New York law. There will be in-class assignments and group exercises to illustrate various concepts. Each student will also prepare and submit various written materials.
Grading and Method of Evaluation:
Letter grade with pass/fail option. Writing assignments and oral presentations.
