Seminar on the Law of Equity

This seminar will focus on the role of equity in the law, including: classically equitable remedies, such as injunctive relief; restitution and unjust enrichment; equitable defenses, such as unclean hands; equity's significance for the law of trusts and corporations; the relation between the common law and equity; equity and individualized justice; and the theory and justification of equitable reasoning. Method of Evaluation: The course will be evaluated based upon a final paper, with the potential for adjustment to grades based upon class participation.
