Fashion Law
This course addresses the principal legal issues and commercial challenges facing the fashion and retail industries in the United States and how these issues inform the practice of law and the legal department of fashion companies. Students will hone their skills in intellectual property (including design protection and anti-counterfeiting), commercial operations and expansion of a brand (including through licensing), commercial agreements (including distribution agreements), employment law and agreements, consulting agreements, compliance with international standards on human rights, marketing and advertising (including emerging media), retail leasing, international trade (including import and customs issues), corporate finance and professional responsibility issues and practice pitfalls. The instructor, an experienced law firm partner with a fashion law practice, will emphasize the practical interplay and tension between commercial realities and legal requirements, and the increasing professional burdens and responsibilities to which in-house counsel are subject. At times, the instructor will use a case-study format, employing actual contracts, policies, and other relevant materials. Grading and Method of Evaluation Letter grade with pass/fail option. Final exam.
