Dispute Res in Matrimonial & Family Law
This simulation course will explore the use of alternative dispute resolution processes in the context of family law matters. It will cover the use of mediation in negotiating divorce, child custody and pre and post nuptial agreements. It will also expose students to the use of Collaborative Law and distinguish how that process differs from mediation. This skills-based course will enable students to learn and practice mediation skills and communication techniques, including: defining the scope of a conflict, eliciting interests and values, active listening, reframing, generating and evaluating options for resolution, as well as analyzing and understanding interpersonal dynamics in order to better facilitate communication and understanding. These skills will be demonstrated and practiced through the use of role-play simulations throughout the semester, culminating in mock mediation and Collaborative Law sessions. Pre or Co-Requisite: Family Law Students who have taken Divorce Mediation Workshop cannot take this course.
