Clinic - Employment Law Credits: 3.00 Faculty: Minna Kotkin In this clinic, each student will represent low-income workers in two types of proceedings: (1) mediations before the NYC Commission on Human Rights concerning harassment and employment discrimination and (2) unemployment insurance hearings. Students will investigate the facts and the law, develop case theory, and prepare a written submission. For the hearings, students will conduct direct examination and cross-examination of the employer and argue the case before an Administrative Law Judge. For the discrimination matters, students will negotiate with the employer and represent the worker in a full day mediation session to attempt to reach a settlement. In addition to these matters, students will also interview and counsel clients as to many other possible employment-related causes of action, including wage and hour, criminal record and family leave violations. The clinic includes a 2-credit seminar that will address both substantive employment law and lawyering skills. Substantive topics will include the topic mentioned above. The skills classes will primarily focus on interviewing and counseling, fact investigation, and trial advocacy, and negotiation.
