Advertising Law

Advertising law refers to both a substantive area of law and a multi-disciplinary field of practice. Advertising law is governed by a patchwork of federal, state, and self-regulatory laws that prohibit false or deceptive advertising, which entails a close review of the wording, imagery, context, and support for a given advertising. These principles apply to all advertising, but there are also specific applications in areas such as environmental or "green" marketing, influencer marketing, and food and supplement marketing. Additionally, advertising often invokes other areas of law, including copyright, trademark, right of publicity, privacy, and sweepstakes law. This course is intended to provide students with both an understanding of the doctrinal underpinnings of advertising law and an appreciation for the practical realities of practicing as an advertising lawyer.
