Employment Law

This course provides a survey of the law governing the employment relationship. We will investigate the basic sources of regulation of the employment relationship and the competing legal models for regulating the workplace. The course will cover a range of issues arising from the employee-employer relationship, including defining "employment," the at-will doctrine and alternatives, employment contracts, post-employment covenants, constitutional and quasi-constitutional protections, workplace torts, protected concerted activity, wage & hour protections, and the rise of arbitration. Although this course will touch on labor law, it will focus largely on laws that apply to workers regardless of unionization status (the National Labor Relations Act is addressed in depth in the Labor Law course). Anti-discrimination laws will not be covered in this course, but will be covered extensively in the Employment Discrimination course.
