On February 26, Professor Bennett Capers was featured on a WNYC radio broadcast discussing the trial of Gilberto Valle, the so-called “Cannibal Cop," a 28-year-old New York City police officer charged with conspiracy to kidnap, kill, and eat women.
While Valle’s attorneys say his online musings were simply fantasies, federal prosecutors say his actions represented a real danger. Capers, a former Assistant U.S. Attorney for the Southern District of New York, discussed the ramifications of the case. Did Valle’s actions cross the “legal line” between fantasy and reality?
“That is the crucial issue that the jurors are going to be wrestling with,” Capers said. “Was this fantasy or did this have the real possibility of becoming a reality?”
Capers discussed specific facts of the case, the testimony of Valle’s wife and the possible effect that this trial could have on the digital landscape.
Capers, an expert in criminal law and procedure, is a prolific writer and commentator on these topics.
