The Motion Picture Association of America is following the steps of recording companies by suing Hotfile, a digital film storage website, for copyright infringement. Hotfile, however, claims it complies with the Digitial Millennium Copyright Act (DMCA), which safe harbors online companies that are not profiting from illegal uploads as long as they remove copyrighted material when requested. Their argument may not hold water though, explained Professor Jason Mazzone to MediaPost News Online. "Unless Hotfile can show that its house is in complete DMCA order, it is on the hook," he said. "Allegations that the site gains financially from piracy and that it doesn't terminate the accounts of infringers could be particularly damaging."
