Last month, U.S. District Court Judge Virginia A. Phillips declared the "don't ask, don't tell" military policy as unconstitutional, citing Lawrence v. Texas, which struck down laws against sodomy in Texas. Judge Phillips' ruling will be reviewed by the 9th U.S. Circuit Court of Appeals in California. Professor Jason Mazzone discussed the possibility of the ruling going up to the Supreme Court with The Washington Times: "If the 9th Circuit affirms the decision by Judge Phillips, then you have a circuit conflict, which is likely to provoke a review by the Supreme Court."
