Law of Condos, Co-Ops and Homeowners Associations
Prerequisite: Property Pre or corequisite: One of the following courses Real Estate Practice, Real Estate Finance, Property Law Colloquium; Community Development Clinic, or Corporate and Real Estate Clinic This course will examine the law of condominiums, cooperatives, and homeowners associations, with an emphasis on the practical considerations that influence developers, owners, and governing boards. Legal issues will be viewed from the perspective of the unique interplay of corporate, securities, and tax law that characterized this area. Topics to be explored include government regulation of the development process including the role of the NYS Attorney General, sponsor obligations, rights and responsibilities of governing boards and unit owners, sales and leases, finances, operations, ethical issues for counsel, and affordable housing.
Grading and Method of Evaluation:
Letter grade with pass/fail option. The grade will be based on a final exam, plus class attendance, participation and performance on a possible class room exercise.
