Competition

Members of the Appellate Division of The Moot Court Honor Society are selected through a two-round intramural competition, held each spring at Brooklyn Law School. Participation in the first round of the competition is required as part of the first-year Legal Writing course. Students are scored based on a composite of their legal writing grade and their performance in oral argument.

To be eligible for consideration for the Society, students must advance to the second round of their respective competitions. Those students who place in the top 25% of their individual Legal Writing sections shall advance to the second round. The Moot Court Honor Society will admit approximately 10% the first year class based on their second round scores. The exact percentage of the first year class to advance to the second round or to be admitted to Moot Court may be altered by the Moot Court Executive Board for good cause.

­Scoring System

­Advancement to the Second Round
The scoring system to determine advancement to the second round shall be weighted in accordance with the following formula:
  • First round oral argument score = 40%
  • Written brief score (first draft Legal Writing grade) = 60%
Students earning less than a B grade on their brief are not eligible to advance to the second round.

­Selection
The scoring system to determine selection of Society members shall be weighted in accordance with the following formula:
  • Second round oral argument score = 60%
  • Written brief score = 40%
Notwithstanding the regulations stated above, the Executive Board may advance out of the first round, and select for membership after the second round, any student whose oral scores place in the top 5% of those who participated in that round.

­Admission in Second Year

Students who are not asked to join the Society after the annual First Year Competition may be considered for membership based on their performance in and completion of the Appellate Advocacy course. Applicants may apply for membership through this process beginning in the Fall semester following their first year. All applicants, including those successfully completing Appellate Advocacy in the summer between their first and second years, will be eligible for membership at the completion of the academic year in which they apply. The number of Appellate Advocacy students admitted, if any, will depend on the needs of the Society and the quality of the applicants.

The Executive Board will consider the following criteria: a submitted brief to the Executive Board; a live oral argument performed before a panel of current Executive Board members; and final grade in Appellate Advocacy.
