THE "DE-ICING" OF TICKET PRICES: A PROPOSAL ADDRESSING THE PROBLEM OF

Legislation regarding the ticket resale business in New York is a source of much debate and rhetoric. The issue is whether New York should continue to regulate the price at which tickets may be resold.

The authors begin with an overview of the ticket resale business and argue that ultimately, analysis of the ticket industry practices will lead to the conclusion that maintaining some control over the price of tickets, while allowing reasonable profits for legitimate resale businesses is essential.

Next, the authors propose legislation that embodies a new approach with a modified "free market" based on an increased "maximum premium price", a category of limited ticket speculation, and a provision making the payment of "ice" or bribes a felony.
