Health Care Rights

This course will explore the current paradigm shift in health law and policy to a rights-based approach. Looking to U.S. laws such as the recent health care reform legislation and anti-discrimination statutes, as well as comparative and international human rights law, the course will analyze what the "right to health" is and the extent to which law does and should reflect this right. We will also explore the benefits, obstacles, and tensions that arise in recognizing and fulfilling a right to health.
