Litigating a Patent Case

The course is a mixture of lectures and written and practical exercises which walks the students through all pre-trial aspects of a hypothetical patent litigation. The course covers pre-filing considerations, prior art and product investigations, written discovery, taking and defending fact and expert depositions, briefing and arguing claim construction, summary judgment, scheduling and evidentiary issues and pre-trial court filings. After successful completion of the course, the student will have developed the practical skills necessary to function as the backbone of any patent litigation team.

Grading and Method of Evaluation

Letter grade only. Students graded on in-class exercises.
