Securities Arbitration Clinic Students Win Double Victory for Elderly Client
September 2007 --- Nabeel Haque ’08 and Mary Beth Yanulis ’08, working in the Securities Arbitration Clinic led by professor Karen van Ingen, successfully represented an elderly client with limited English speaking ability. The woman claimed her broker purchased and sold securities in her account without her permission while she was out of the country.
The students spent a great deal of time interviewing and counseling the client. Eventually, they drafted and filed a Statement of Claim on her behalf and against both the broker and the broker dealer. Although the discovery phase of the matter was contentious, it was successfully completed. At the pre-hearing conference, a hearing date was set for September 27, only three weeks into the fall semester.
Over the summer, Haque negotiated with an assistant general counsel for the broker dealer, and successfully reached a settlement for close to 80% of the damages claimed. The client was ecstatic! However, the individual broker was not part of the settlement and remained in the case.
The student team prepared for trial while pursuing negotiations with the broker’s counsel. On the day of the arbitration, armed with a draft settlement agreement and standing just outside the arbitration room, the students took up negotiations again with the broker and his counsel. With their thorough preparation, negotiating skills, and the draft document, they were able to conclude the matter with yet another check for the client. She was not only pleased with the outcome, but very proud, she said, of “her” student team!
